Not just any tenant or occupant may make a claim. There are some eligibility criteria that must be fulfilled before one can claim.
You must fulfill the following criteria to make a claim
One major reason why you should make a claim is that it is your legal right to do so. Section 11 of The Landlord and Tenant Act (LTA) 1985 which is effective upon tenancy agreements entered into after 1961 stipulates the responsibilities of a landlord towards the tenants.
These include
When these are not done, then the tenant may have strong grounds to make a claim.
When claiming compensation, there are some issues you can make claims for which your compensation amount can cover. You can make compensation claims for
where the disrepair in your home has ruined or damaged some of your properties. You will do well to note them when making claims, provide proof and your compensation amount will take care of these. For instance, if fire as a result of faulty electrical installations consumed your property, you can claim for damages. You can also claim compensation where mould and damp ruined your books, documents or clothes. Pictures showing the extent of damage will be required so as to ensure you are adequately compensated.
You can also claim for inconveniences suffered if the damages incurred have made it impossible to live in the apartment or make use of certain areas of the apartment. This may be as a result of fire outbreak from faulty electrical installations, leaks, flooding, mould and damp or rodent, vermin and insect infestation.
Of course, you can make claims where you have suffered injuries, pains or some health issues as a result of the disrepair. For example, where you have been injured as a result of structural defects, falls as a result of slippery surfaces from leaks, or health issues arising from extreme cold as a result of a faulty heating system, you can make claims and show proof of these.
You can include a doctor’s report and also show how much financial losses you have incurred as a result of these.
Any financial loss incurred either due to ill health or in the course of replacing damaged properties can be claimed for. Receipts are very essential here and will be needed to determine the amount of losses incurred so that you can be adequately compensated for them.
